As a Kelly employee, the Employee Service Center is your first line of support with payroll-related matters. Bilingual customer service representatives are available to help you with:
• Claim for incorrect check or payment of wages
• Update of postal addresses
• Direct Deposit Questions

• Questions related to payroll or tax deductions
• Status of checks, requirements for recording hours worked, among others

Every employee shall be entitled to a minimum accrual of vacation leave by working at least one hundred and thirty (130) hours per month. The minimum monthly accrual of vacation leave will be:
• One-half (1/2) day during the first year of service; for a total of enjoyment of up to six (6) days on your anniversary year.
• Three quarters (3/4) of a day after the first year of service until five (5) years old; for a total enjoyment of up to nine (9) days.
• One (1) day after five (5) years of service until fifteen (15) years of service; for a total enjoyment of up to twelve (12) days.
• One and a quarter (1 1/4) days after completing fifteen (15) years of service; for a total enjoyment of up to fifteen (15) days.
Working employees recruited on or before January 26, 2017, will accumulate according to the time of their recruitment.
By written agreement between Kelly and the employee, vacations will be granted consecutively annually; These can be divided as long as the employee enjoys at least five (5) consecutive working days of vacation during the year, and they do not interrupt the normal functioning of the operations of the company in which he is performing his duties.
Vacation days will accrue from the start date of employment.
Those employees assigned to companies that close for periods of maintenance carried out may be eligible to enjoy the accumulated vacation days during that period. An interested employee should contact their Kelly representative for more information.
Sick Pay
Every employee shall be entitled to sick leave with full pay at the rate of one (1) working day for each month in which he has had at least one hundred thirty (130) hours of work.
Sick leave not used during the course of the year will be accumulated for successive years up to a maximum of fifteen (15) days.
In order to receive sick leave pay it is your responsibility as an employee to notify Kelly of the fact of her illness as soon as possible and no later than the day of her absence. Kelly will not pay for sick days that have not been notified to Kelly's supervisor.
Employees may use the accumulated days for sick leave, up to a maximum of five (5) days and as long as they have a balance of five (5) days, to attend to:
• The care and attention due to illness of your sons or daughters, your spouse, mother or father.
• The care and attention due to illness of minors, elderly people, or people with disabilities over whom you have custody or legal guardianship.
Consuming sick leave does not excuse compliance with those rules of conduct validly established by the employer, such as attendance, punctuality, medical certifications if the absence exceeds two (2) working days and periodic reports on the continuing illness. The required medical certifications will also apply to illnesses or conditions of the employee's children, spouses, and parents, as well as in the case of minors, elderly people, or people with disabilities under their custody or legal guardianship.
Holiday Pay
• To qualify for holiday pay under the plan, the eligible employee must meet the following three (3) requirements:
1. Work (and be paid for) 960 hours during the 26 weeks prior to the holiday, and
2. Work (and be paid for) 30 hours during the week before the holiday, and
3. Be available to work during the week of the holiday.
• Holiday pay will be paid the week following the holiday.
• There are four holidays covered under this plan:
New Year's Day
Independence Day
Thanksgiving Day
Christmas Day
The holiday pay program may be cancelled or modified at any time. If there is a qualifying holiday, your pay will be reflected in the week following the holiday. This benefit may vary depending on the client you are assigned to be sure to check with your Kelly representative when starting an assignment.

*Please note qualifying for holiday pay will not automatically remove your shift. You must request leave or be included in staffing reductions with no shift in place to receive holiday pay.

Special Leave for Employees with Serious or Catastrophic Illnesses
Employees who have worked for their employer for at least twelve (12) months may avail themselves of this Special Leave with pay of up to a maximum of six (6) annual working days, in addition to those they are entitled to by law. For details on serious or catastrophic illness please contact your Kelly Representative.
Special Leave for Workers in Case of a Health Emergency
During a state of emergency declared by the Governor or by the Secretary of the Department of Health, the employee:
• Suffering or suspected of suffering from the disease or epidemic that caused the state of emergency, and
• Having exhausted all the licenses to which the employee is entitled, they may use this special license.
• Therefore, once the vacation and sick leave to which employees are entitled has been exhausted, they will have the right to receive up to (5) days with pay charged to the Special Leave for Workers in Case of a Health Emergency.
Note: This law is an amendment to Article 6 of Law 180-1998, as amended, known as the “Puerto Rico Minimum Wage, Vacation and Sick Leave Law”.
It is a program that pays benefits to staff who are unable to continue working due to a non- employment-related illness or accidents or an automobile accident. For more information you should contact your Kelly supervisor.
Insurance Program for Drivers and Other Employees (Driver Insurance)
Insurance Plan for drivers in PR and other employed persons who operate a motor vehicle in their work, which covers the risks of illness, permanent total disability or death of the insured, their spouse and children under 15 years of age and a bonus after turning 65 years of age or older.
State Insurance Fund
You are covered by the State Insurance Fund. If you have an accident during working hours, it is very important that you remember that Kelly is the employer and so notify your Kelly office to avoid any inconvenience or confusion. If possible, you should try to report immediately to your nearest Kelly office. We have a maximum period of five (5) days to report the accident. You should keep your Kelly supervisor informed of all follow-ups on your condition and call us immediately once the Fund notifies you of how they will proceed with your condition.
For information on leave such as FMLA, Military Leave, Non-Occupational Disability Insurance, among others, please contact your Kelly supervisor.
Jury Duty License
Every employee summoned to serve as a jury in a P.R. Court, will have the right to enjoy paid leave from their employer for up to a maximum of fifteen (15) working days. If the citation is for the Federal District Court of PR, your appearance will be paid by your employer without limit of days. In order to process the payment, the Secretary of the Court must issue a certification that clearly states the time that he had to dedicate to the appearance, with a detail of the days and hours. The employee must inform the employer of it, at least five (5) business days prior to the date for which he has been summoned.
Special License for Victims of Violence
Pursuant to this new law, employees in Puerto Rico can take up to fifteen (15) days of unpaid leave each calendar year to address situations related to domestic or gender violence, child abuse, sexual harassment at work, sexual assault, lascivious acts or stalking in its serious form.
These fifteen (15) days may not be cumulative or transferable to the following calendar year. The new "Special Leave" is in addition to any other leave to which the employee may be entitled under the law.
Employees can also take Special Leave when the victims are their family members. Covered family members, as defined by law, include sons or daughters, spouse or their partner united by emotional relationship, mother, or father of the employee; and minors, elderly people or people with disabilities over whom they have custody or legal guardianship.

Military License
Kelly is proud to support our employees with their military obligations. We comply with all provisions of the Uniformed Services Employment and Reemployment Rights Act (USERRA) and applicable state laws. If you are called to active duty or enlist in the United States uniformed services, you retain your legal rights to continued employment under applicable state and federal laws. A qualified employee is considered to be on unpaid leave while in the military and should contact their Kelly supervisor to review eligibility for paid leave (earned time) and benefits available while on leave. military. The time frame for returning to work depends on the length and nature of the service. Benefits based solely on length of service will be reactivated once you return to Kelly. You must submit written details of any military service commitment to your Kelly supervisor as soon as possible after receipt. License for Witness in Criminal Cases
It is prohibited to deduct from wages or vacation or sick leave hours that an employee appears as a witness in a criminal case. The employee must inform the employer, with reasonable time, which is not less than two (2) days before appearing in court as a witness in a criminal case, except
in the event the employee has not received two (2) days advance notice of his or her need to be absent from work to attend to the citation.
Special Sports License
Any employee who is an athlete certified by the Olympic Committee and who represents Puerto Rico in the Olympics, Pan American or Central American games and in regional or world championships, may enjoy a maximum of thirty (30) annual working days without pay.
Other Legally Required Leaves of Absence
Employees will be granted other leaves of absence as required by law, or in order to comply with any required legal or military obligation. Employees are required to provide reasonable advance notice of the need for such leave.
